SWEEPSTAKES OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE NINETEEN (19) YEARS OF AGE OR OLDER AT THE TIME OF ENTRY, SUBJECT TO THE EXCLUSIONS IN THE ELIGIBILITY SECTION BELOW.
1. TWO WAYS TO ENTER: (1) Go to www.GrillwithBIC.com between 12:00:01 a.m. (ET) on July 1, 2010 and 11:59:59 p.m. (ET) on September 30, 2010 and follow the online instructions for completing an entry, OR (2) hand print your name, street address, city, state, zip code (no post office boxes allowed, only street or rural route addresses are acceptable), day and evening telephone number with area code, birth date on a 3” x 5” card, and mail in a stamped #10 envelope to: BIC Multi-Purpose Lighter Sweepstakes” PO Box 576 Hanover, MD 21076. All mail-in entries must be postmarked by September 30, 2010 and received by October 7, 2010. All online entries must be submitted and received by 11:59:59 p.m. (ET) September 30, 2010. Limit one (1) entry per day. No mass entries, photocopies or mechanically reproduced entries will be accepted. Sweepstakes begins at 12:00:01 a.m. ET on July 1, 2010 and ends at 11:59:59 p.m. ET on September 30, 2010.
2. SPONSOR: Sponsored by BIC USA Inc., One Bic Way, Suite 1 Shelton, CT 06484 (“Sponsor”). Sponsor will not divulge personal information from eligible entries to any third party vendors.
3. PRIZES: GRAND PRIZE: There are one hundred (100) Grand Prizes. The Grand Prize is a Weber® Fireplace with an approximate retail value (ARV) of $159 per fireplace. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. No prize substitution or cash redemption, except at Sponsor’s sole discretion or as otherwise provided herein. Prizes are not transferable. Prize does not include firewood.
PRIZES SUBJECT ONLY TO MANUFACTURERS WARRANTY WHERE APPLICABLE, WITHOUT WARRANTY BY SPONSOR OF ANY KIND, EXPRESS OR IMPLIED, WITHOUT LIMITATION.
4. SWEEPSTAKES ENTRIES: Sponsor and its subsidiaries, parent companies, affiliates and/or agencies are NOT responsible for lost, late, incomplete, illegible entries or mail, mutilated, destroyed, damaged, delayed, falsified, incomprehensible, misdirected, undelivered, garbled, stolen, or postage due entries; computer errors; failures in servers or other connections or communications; or other errors of any kind nor for any injury or damage to an entrant’s or other person’s computer related to or resulting from participation in the Sweepstakes. All entries become the sole property of Sponsor and will not be returned or acknowledged. All entry information will be held and used in accordance with Sponsor’s privacy policy (www.grillwithbic.com). In the event of a dispute concerning who submitted an email entry, the entry will be declared to have been made by the authorized account holder of the email address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
5. DRAWING: A random drawing will be held on or about October 14, 2010 from all valid entries received by be3 Marketing Group, LLC, an independent judging organization, whose decisions are final with respect to all matters relating to this Sweepstakes. The odds of winning depend on the number of eligible entries received. Potential Grand Prize winners will be notified by telephone on or about October 21, 2010. If potential winner cannot be reached or fails to respond for a period of seven (7) calendar days following first attempted notification, prize will be forfeited and an alternate winner will be randomly selected. Potential winner will be sent via overnight mail an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release. Potential winner must execute and return any required Affidavit of Eligibility/Release of Liability Form, and where legal, a Publicity Release, within seven (7) days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected. Limit one (1) prize per person. No substitution, transfer or cash redemption of prizes permitted, except at Sponsor’s discretion. All federal, state and local taxes, and other charges, if any, are the sole responsibility of the winner. If any prize becomes unavailable, Sponsor reserves the right to substitute another prize of equal or greater value. By entering Sweepstakes, entrants agree to abide by and be bound by these Official Rules and the decisions of Sponsor and be3 Marketing Group, LLC, which shall be final and binding in all respects. Acceptance of prize offered constitutes permission to use the winners’ name, likeness and/or photograph and statements for advertising/trade purposes in any and all media, and all media now or hereafter known worldwide, without further compensation, notification or permission, unless prohibited by law. By participating, winners release Sponsor and its parent companies, affiliates, subsidiaries, distributors, advertising and promotional agencies, the judging organization, and their respective directors, officers, employees and agents, from any and all liability with respect to all aspects of the Sweepstakes and the possession, acceptance, use or misuse of prizes. Entrants who do not comply with Official Rules or who attempt to interfere with the Sweepstakes in any way shall be disqualified.
6. ELIGIBILITY: The Sweepstakes is open to legal residence of the 50 United States and the District of Columbia who are 19 years of age or older at the time of entry. Persons in any of the following categories are NOT eligible to win a prize: (a) Employees or agents of Sponsor and be3 Marketing Group, LLC, their parent companies, subsidiaries, affiliates, distributors, subsidiaries, advertising and promotion agencies, (b) individuals engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All federal, state and local laws and regulations apply. Void where prohibited, taxed or restricted by law.
7. SWEEPSTAKES INTEGRITY: Sponsor reserves the right to suspend or terminate the Sweepstakes, if in Sponsors sole discretion; the Sweepstakes becomes infected or otherwise corrupted. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, incorrect or inaccurate entry information, computer bugs or viruses; failures in servers or other connections; lost or interrupted or unavailable network, miscommunications, failed phone or hardware or software transmission failure or loss; delayed or corrupted data transmissions; garbled or jumbled transmissions or for any other error of any kind, whether computer, technical printing, typographical, human or other, relating to or in connection with the Sweepstakes including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the announcement of the prize, the processing of entries or in any Sweepstakes related materials, or inaccurate transmissions of or failure to receive visit information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes or any element thereof. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed ‘void’ by the judges.
